- The Kansas Asbestos Program is housed in the Bureau of Air and Radiation, under the Radiation and Asbestos Control Section.
- Kansas statutes and regulations, along with KDHE’s authority, guide asbestos control and ensure compliance with federal EPA standards.
- KDHE is authorized to implement the EPA’s National Emission Standards for Hazardous Air Pollutants (NESHAP) for asbestos management.
- According to KDHE State of Kansas Regulations & Statutes, an asbestos-related demolition involves tearing down all or part of a structure with friable or potentially airborne asbestos materials.
- Residential demolitions are excluded unless they are subject to 40 C.F.R. Part 61, Subpart M, adopted by K.A.R. 28-19-735.

National Emission Standards for Hazardous Air Pollutants (NESHAP) for Asbestos
The regulatory requirements were enacted to protect public health and welfare. They are good practices to follow, even if your demolition or renovation project involving asbestos-containing materials (ACM) in a residential building is not subject to federal asbestos regulations.
- There are specific federal regulatory requirements that require the identification of asbestos-containing materials (ACM) in many residential buildings being demolished or renovated by a municipality.
- There may also be state and local regulations that apply to the identification of such materials.
- The NESHAP for asbestos applies to most demolition projects conducted by municipalities, counties, and land banks.
Inspection
For demolitions subject to the asbestos NESHAP, the regulation requires a thorough inspection before demolition or renovation begins.
The residential structures, or portions of the structures that will be demolished or renovated, must be thoroughly inspected for the presence of asbestos, including Category I and Category II non-friable ACM.
Information gathered during the inspection allows the owner or operator to determine which NESHAP requirements apply to the demolition or renovation project.
